The Inquiry sat today to complete the evidence of Pat Wertheim (Independent Fingerprint Examiner). Mr Wertheim’s evidence today was taken by means of a video link.
Friday 20 November

These witnesses will not be called to give oral evidence to the Inquiry and their statements will therefore form the basis of their evidence to the Inquiry.

Thursday 19 November
The Inquiry will next sit on the afternoon of Monday 23 November, when it is intended that Pat Wertheim (Independent Fingerprint Examiner) will complete his evidence. On this occasion, Mr Wertheim’s evidence will be taken by means of a video conference link.
As there are no video conference facilities within the Inquiry hearings venue at Maryhill Community Central Halls, the hearing on Monday will be held in Causewayside House, 160 Causewayside, Edinburgh, EH9 1PR, within the offices of Digby Brown Solicitors. The nearest railway station is Waverley, which is approximately a thirty minute walk to the office. Alternatively buses from South Bridge stop nearby. (including 3, 3a, 31, 5 and 8).
This hearing will be open to the public. It will commence at 4pm and is expected to last around 2 hours. There will be no other witnesses on Monday 23 November.
The Inquiry will sit again at the Inquiry hearing venue in Maryhill on Tuesday 24 November when it is expected that we will hear from Gary Pugh (Director of Forensic Services, Metropolitan Police) to be followed by Professor Christophe Champod (Professor of Forensic Science, University of Lausanne) on Wednesday 25 November.

Today the Inquiry heard from Paul Chamberlain (Senior Forensic Scientist, Forensic Science Service). There will be no Inquiry hearings on Thursday 19th and Friday 20th November. A progress report later this week will set out the planned programme for next week, the last week of hearings at Maryhill.
Tuesday 17 November
Scott Pattison (Director of Operations, Crown Office) completed his oral evidence today. The hearing will begin again at 9.30am tomorrow, when it is expected that we will hear from Paul Chamberlain (Senior Forensic Scientist, Forensic Science Service) There will be no Inquiry hearings on Thursday 19 and Friday 20 November 2009.

Today the Inquiry heard from Robert MacKenzie (Fingerprint Officer SCRO) and Fiona McBride (Fingerprint Officer SCRO). This completes the main evidence from the SCRO witnesses. The Inquiry will now move on to hear evidence from the Scottish Police Services Authority and the Crown Office beginning tomorrow with Joanne Tierney (Fingerprint Unit Manager).

The Inquiry hearings recommenced today with a brief introductory statement by Senior Counsel to the Inquiry, Mr Gerry Moynihan. This can be viewed in the transcript of today's proceedings. This was followed by oral evidence from the first of the witnesses for this phase of the hearings, Pat Wertheim from the USA. Mr Wertheim was instructed by Shirley McKie and David Asbury in relation to the marks with which the Inquiry is concerned.
Mr Wertheim's evidence will continue tomorrow.

Today the Inquiry completed the oral evidence of Edward Bruce, a fingerprint examiner who worked for SCRO and was involved in the ‘blind testing’ of mark Y7. This concluded the Inquiry’s first session of oral hearings.

Today the Inquiry took oral evidence from Detective Inspector William Shields, who was involved as a Detective Sergeant in the Marion Ross murder inquiry, and from Malcolm Graham, a retired fingerprint examiner who was involved in identifying fingermark Y7. Thereafter the Inquiry began to take evidence from Edward Bruce, a fingerprint examiner formerly with Scottish Criminal Records Office, and now with SPSA.
The Inquiry will sit again at 10am on Friday 10 July when it will continue to take evidence from Mr Bruce.

The Inquiry began the evidence of Det-Insp James Kerr.

The Inquiry then heard evidence from Mr (formerly Police Constable) Kerr Reid. Tomorrow Wednesday the Inquiry expects to hear from a number of Scene of Crime Officers.

Mr Stuart Holmes of Turcan Connell made an opening statement on behalf of Alan Dunbar, Terence Foley, Alister Geddes, David Halliday, Fiona McBride, Anthony McKenna, Robert Mackenzie, Hugh Macpherson and Charles Stewart. The other representatives present did not wish to make an opening statement, and absent core participants had not intimated an intention to make an opening statement. No submissions were made. Accordingly, following a ruling by the Chairman on two matters, proceedings were adjourned until Tuesday 9 June at 10.15 am when the taking of evidence will begin.

Wednesday 3 June
Senior Counsel to the Inquiry today completed his opening statement with chapters on the Crown Office and Procurator Fiscal management of the preparation for the trial in HMA v Asbury, SCRO preparation of reports for HMA v Asbury and HMA v McKie, the preparation for the prosecution in HMA v McKie, the trial in HMA v McKie, and reviews post-McKie, including the treatment of staff. Mr Andrew Smith QC began an opening statement on behalf of the core participants represented by Mr Dalyell of Digby Brown, namely David Asbury, Iain McKie & Shirley McKie. At tomorrow’s hearing Mr Smith will complete his opening statement and other opening statements, and any submissions, on behalf core participants, will be taken. The hearing will begin at 10.15 and is not expected to continue beyond lunchtime.
Tuesday 2 June
The Inquiry is part way through the opening statement of Senior Counsel to the Inquiry. The announcement about the start of the hearings is available here. Following an introduction in which he set out his approach, Mr Moynihan QC has so far addressed the Law and Practice in relation to fingerprint evidence, the initial investigation of the crime scene to 13th January 1997, including the finding of mark XF and Ms. McKie’s involvement, the finding and identification of marks XF, QD2 and QI2 and detention of David Asbury, and the finding and identification of Y7 and Z7 and checking of Y7 within SCRO.
